Licensed vs. Unlicensed Cannabis Dispensaries in Washington DC
Two kinds of cannabis shop have operated in DC: licensed medical retailers, and unlicensed shops that grew out of the so-called gifting market. They are not the same. Last reviewed: October 2026.

- Regulator: licensed stores are overseen by ABCA. Unlicensed shops have no cannabis regulator.
- Testing: licensed products must pass independent lab tests for potency and contaminants. Unlicensed products have no testing requirement.
- Labeling: licensed products follow packaging and ingredient labeling rules. Unlicensed products may carry any label, or none.
- Who can buy: licensed stores sell to registered patients. Unlicensed shops typically ask for nothing.
- Legal status: licensed sales are legal under DC’s medical cannabis law. Unlicensed sales are not, and ABCA has been closing those shops.
How the gifting market came about
DC voters legalised possession in 2014, but Congress blocked the District from setting up recreational sales. Shops began gifting cannabis with the purchase of another item. DC has since opened a route for those shops to become licensed medical retailers and has stepped up enforcement against the ones that didn’t.
